PAXFUL VIP TRADER PROGRAM TERMS AND CONDITIONS

BY PARTICIPATING IN THE VIP TRADER PROGRAM, YOU AGREE TO THESE OFFICIAL RULES AND THE PAXFUL USER AGREEMENT. Paxful Users participating in the Paxful VIP Trader Program (the "Program") shall be subject to the following Terms and Conditions (the "Terms").

1. Eligibility

The Program is open to individual traders ("Participants") who meet the Company's criteria for VIP Trader status, which may include but is not limited to:

  • Meeting certain minimum average monthly trading volume thresholds in the top tier of all Paxful traders.
  • Maintaining a Paxful account ("Account") in good standing as defined by account status, such as frozen or suspended.
  • Compliance with all other requirements set forth by Paxful.
  • Participants may become ineligible if in violation of the User Agreement, regulatory compliance concerns are evident, or at Paxful's discretion if participant conduct violates Paxful policy (collectively the "Eligibility Requirements")

Participants meeting the Eligibility Requirements will be contacted by Paxful via email and may also be contacted via other social networking tools, such as Telegram or WhatsApp.

2. Term

Participants shall remain in the Program for three (3) months following the selection date or until the Program terminates, whichever is the shortest (the "Program Termination").

3. Termination

  • 3.1. Participants shall be removed from the VIP Program and the Telegram group if their trading volume declines in three (3) consecutive month-over-month periods following their initial three (3) month inclusion in the Program ("Removal").
  • 3.2. Removal shall cause participants to cease being eligible for rebates or other Program benefits as determined by Paxful and subject to change by Paxful from time to time with no notice to Paxful users or Program Participants.
  • 3.3. Paxful reserves the right to remove Participants at its sole discretion before the Program Termination date.
  • 3.4. Following removal, participants will be removed from the Program Telegram Group and other exclusive Program social media channels.

4. Program Rebates

  • 4.1. Participants meeting the Eligibility Criteria may receive rewards as a rebate (the "Rebate") for increasing the Participant's individual monthly trading volume as determined by Paxful at its sole discretion.
  • 4.2. Rebates will be issued directly to the user's Paxful account no later than thirty (30) days after the close of the month of measurement in USDT.

5. Program Modification

Paxful reserves the right to modify, suspend, or terminate the Program at any time, with or without prior notice. Changes may include adjustments to eligibility criteria, benefits, or any other aspect of the Program.

6. Privacy and Data Protection

By participating in the Program, you consent to collecting and using your personal data following the Privacy Policy. Your data may be shared with third-party service providers to fulfill the Program benefits.

7. Limitation of Liability

By participating in the Program, you agree to and hereby do release and hold harmless Paxful, its subsidiaries and its affiliates from any damage, injury, death, loss, claim, action, demand, or other liability (collectively "Claims") that may arise from your acceptance, possession and/or use of any benefit or your participation in this Program, regardless of whether such Claims, or knowledge of the facts constituting such Claims, exist at the time of entry or arise at any time after that.

8. Disputes

BY PARTICIPATING IN THE PROGRAM, YOU AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION THAT CANNOT BE RESOLVED BETWEEN YOU AND PAXFUL ARISING OUT OF OR CONNECTED WITH THE PROGRAM, OR ANY REBATE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED, (IF ANY), NOT TO EXCEED TWENTY FIVE DOLLARS ($25.00), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED TWENTY FIVE DOLLARS ($25.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) YOUR REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND YOU IRREVOCABLY WAIVE ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.
